GIANNOS TRANSPORT SL, “ or ‘we’) through the Spanish version of https://giannostransport.com/ (the ‘Website’). The sale is only available for purchases made within the Spanish territory, excluding the Canary Islands, Ceuta and Melilla (hereinafter, the “Territory”).

Your use of the Web Site to make a purchase, or for any other purpose, constitutes your tacit agreement to abide by and be bound by these Terms and Conditions, the Terms of Use of the Web Site (the “Terms of Use”, (available at https://giannostransport.com/ ), our Privacy Policy (available at https://giannostransport.com/ ) – documents incorporated into the Web Site by reference – and any notices that may be posted on the Web Site in the future, as well as applicable laws and regulations. These are the terms and conditions governing our provision of products and services. Please read these Terms and Conditions carefully before placing your order on our Web Site. These terms explain who we are, under what conditions we offer our products and services, how the contract can be changed – by us or by you – or terminated, what to do if a problem arises and other important information. If you disagree with any of the provisions of these Terms and Conditions, Privacy Policy or Terms of Use, please do not place an order through the Website.

ORDERS

Only those persons who (a) have reached the age of majority (18 years of age) and (b) have the legal capacity to enter into contracts may place orders for GIANNOS TRANSPORT SL products through the Website, following the indications described therein. Unfortunately, orders cannot be processed by e-mail. All orders are subject to subsequent written acceptance by GIANNOS TRANSPORT SL. As a user, you are responsible for checking that the information presented in your shopping cart correctly reflects the selection made before confirming your order. After confirmation (by clicking on the “Buy” button, as explained below), the order will be sent to GIANNOS TRANSPORT SL for processing and, within twenty-four (24) hours, you will receive an e-mail confirming receipt of your order and attaching your order details. This e-mail does not constitute acceptance of your order. After the processing of your order, at the moment of proceeding to the shipment of the ordered products, you will be sent an e-mail confirming the order. Likewise, GIANNOS TRANSPORT SL reserves the right to request verbal confirmation of orders placed.

In the event that you are asked to verbally confirm an order, you must confirm your selection by telephone and the confirmation e-mail is not sufficient to establish the contractual relationship.

The images of the products presented on our Web Site are for illustrative purposes only. While every effort is made to ensure that the images accurately reflect the color of the products, we cannot guarantee that their display on a particular device will accurately reflect the actual color of the products. The products you receive may be slightly different from those presented in such images. Consequently, and to the maximum extent permitted by law, GIANNOS TRANSPORT SL shall not be liable for any errors or inaccuracies that may be contained in the photographs or graphical representations of GIANNOS TRANSPORT SL products presented on the Website. Only orders that are for personal use will be processed, excluding all those that are considered to be of a commercial nature.
GIANNOS TRANSPORT SL reserves the right to cancel your order if you have been involved in a dispute with any previous order; or if GIANNOS TRANSPORT SL has reasonable grounds to believe that you have breached these Terms and Conditions; or if you are, or there is reason to believe that you are, engaged in fraudulent activities; or the products purchased are not for the personal use permitted in these Terms and Conditions. Also, GIANNOS TRANSPORT SL reserves the right to refuse orders if it deems appropriate. A maximum of three (3) products may be purchased per order.

ORDER CONFIRMATION
To process your order, you must select the product you wish to purchase and click on the “Add to Cart” button. The selected products will be added to the “Shopping Cart” and you can then proceed to fill in the order form and accept the General Terms and Conditions of Sale. Before placing the order, you will be asked to check the accuracy of the information provided and make any necessary corrections, if applicable. The order will be placed by clicking on the “Pay” button. Once the order has been placed, and within twenty-four (24) hours at the latest, you will receive an automatic e-mail confirming receipt of your order. Please note that clicking on the “Pay” button does not mean that your order has been accepted or that the purchase has been successfully completed.

The order constitutes an offer for the purchase of one of our products. Upon receipt, the order will be sent to GIANNOS TRANSPORT SL for processing, so it can no longer be modified or canceled, unless otherwise stated in these Terms and Conditions or otherwise provided by law. All orders are subject to our acceptance, which will be communicated to you by sending an email informing you of the shipment of the product and attaching the corresponding tracking number (the “Order Confirmation”). The contract between us will only be formed when we send you the Order Confirmation. The contract will only refer to the products whose shipment we specify in the Order Confirmation. GIANNOS TRANSPORT SL files for its own records the documentation of all transactions made between GIANNOS TRANSPORT SL and its customers. You may download and file for your own records both these Terms and Conditions and the Order Confirmation. In the event of a dispute between GIANNOS TRANSPORT SL and a customer in connection with a transaction made on the Website, the data recorded by GIANNOS TRANSPORT SL will be used as evidence of the details of such transaction.

GIANNOS TRANSPORT SL will send you an electronic copy of the invoice for the products purchased together with the Order Confirmation and, if required, a printed copy of the invoice together with the products to be shipped to you, either to the address you provide or at our store at Barriada Ecce Homo 26 14620, Carpio (El), Cordoba, Spain in case you have selected the store pick-up option, as applicable.

Some products on the website may only be available for the reserve option. Subject to the terms and conditions stipulated in this document, as well as those mentioned on the individual web pages of the products available for reservation (delivery period and delivery options), reservations will be covered by the same processes and conditions applicable to standard orders. It is not possible to add products in stock and reserved items in the same order, which means that you will have to place separate orders. If you make a reservation for several products with different delivery dates, the complete order will be shipped when all products are ready for shipment, i.e. the last shipment date will apply.

The complete list of accepted payment methods for reservations is available on the specific page for payment, which you can view before completing the order. Once the reservation is completed, GIANNOS TRANSPORT SL will process the purchase transaction by immediately charging the amount to the selected payment method and will send you the confirmation of receipt of your order. As soon as your reserved product is ready to be shipped, you will receive an email with the shipping confirmation. Due to production constraints, GIANNOS TRANSPORT SL may be forced to cancel all or part of a reservation. GIANNOS TRANSPORT SL will inform you of this cancellation as soon as possible and will refund the amount paid in the same payment method used for the purchase.

AVAILABILITY

BULGARI reserves the right to periodically modify the selection of items offered on the Website without prior notice to customers. GIANNOS TRANSPORT SL will not be responsible for the lack of stock or availability of its products.
If you place an order and that particular product is out of stock, GIANNOS TRANSPORT SL will refund the amount paid for it through the payment method you selected at the time of purchase (excluding any third party card charges).

PRICES AND PAYMENTS

The prices of GIANNOS TRANSPORT SL products are indicated in euros (EUR), including applicable taxes and excluding shipping costs, if any.

GIANNOS TRANSPORT SL reserves the right to modify the price of the products offered on the Website at any time and without prior notice. In the face of the sale, the price indicated on the Website at the time of order confirmation with the “Pay” button will be charged.
You will be responsible for the costs incurred by the use of remote means of communication for placing an order with us (cost of Internet access, cost of telephone, etc.), and these costs will not modify the price of the products ordered.
GIANNOS TRANSPORT SL reserves the right to correct any errors or inaccuracies that may be on the Website, as well as to cancel orders in the event of inaccuracy of such information. Immediately after clicking the “Pay” button, you will be required to pay for the order placed on the Website. The amount corresponding to the purchase of the products will be blocked on your credit or debit card, but will only be charged after the shipment of the products. We only accept payment by credit or debit card.

Vouchers issued by GIANNOS TRANSPORT SL boutiques cannot be used to purchase the products offered on the Website. All orders must be paid in Euros (EUR).
Please note that the shipping address specified during the order process must be within the Territory. Orders whose shipping address is not within the Territory will not be processed.

RESERVATION OF TITLE

The products included in your order will remain the property of GIANNOS TRANSPORT SL until GIANNOS TRANSPORT SL has received the payment of the full amount corresponding to such products, guaranteeing your interest in them. If there is any problem with the payment, you will be responsible for returning to GIANNOS TRANSPORT SL the products received immediately after your order.

DELIVERY AREA

Products purchased through the Website will only be delivered to the shipping address specified during the ordering process, provided that it is within the boundaries of the Territory.
Please note that P.O. Boxes are not valid for the delivery of our products. If you wish to indicate a hotel address as the shipping address for your order, please note that the products will only be delivered to the holder of that order, not to the hotel reception.

SHIPMENT OF THE ORDER

During the order process, GIANNOS TRANSPORT SL will inform you of the time usually required to carry out the shipment, as well as the different methods available for the shipment of the purchased products. During the order process you will also be asked to select the shipping method. If any, the shipping costs will depend on the amount of the order and the shipping method selected. GIANNOS TRANSPORT SL reserves the right to split the order into partial shipments. If this right is exercised, your credit or debit card will only be charged the amount corresponding to a single shipment. Although GIANNOS TRANSPORT SL cannot guarantee the actual shipping time, the following general shipping options can be estimated:
Express shipping: products will be delivered within 5 to 10 working days from the date of Order Confirmation.
For personalized products (engraving in the case of jewelry creations and hot stamping in the case of accessories), please note that the delivery time may be 10 to 15 days.
At the time of delivery, a person of legal age (18 years old) will be required to sign the order delivery confirmation. The order holder assumes that the person picking up the products at the designated address will be authorized to do so.

DELIVERY PROBLEMS

In the event of non-delivery, ten (10) working days have elapsed since the date of shipment without receipt of the products or there is any difference between the products ordered and those delivered, you should report the situation to our Customer Service by calling +34 XXXXXXXXXX, sending an email to contact@giannostransport.com or via the live chat function of the Website as soon as possible.

STORE PICK UP

The “Pick up in store” is an optional shipping method offered by our store in C/ JORGE LUIS BORGES, 4 BUZON 65URB.TERRA BRAVA. If you select the option “Pick up in store”, your order will be sent to that boutique, where you can pick it up whenever you want. You can check the opening hours of the boutique in the “Pick up in store” section of the Website.
We will send you an email confirmation (i) when we ship your order and (ii) when your order is ready for pick-up.
We will make every effort to ensure that your order is ready for collection within the estimated timeframe (within the next few business days). Unfortunately, it is likely that, during sales periods or peak seasons, as well as as a result of unforeseen factors or events beyond our control, delays may occasionally occur. In the event of such incidents, and to the maximum extent permitted by law, GIANNOS TRANSPORT SL will not be responsible for any delays or the impossibility of collecting your order within the estimated delivery times.
Please bring with you, when you collect your order, a printed copy or proof on your mobile device of the email informing you that your order is “available for collection”, together with your valid identity document with a photograph attached.

In the event of collection by a person designated by you, in addition to the email informing you that your order is “available for collection”, it will be necessary (i) an authorization signed by you stating the name, surname, date and place of birth of the authorized person, and (ii) a valid copy of both your identity card and that of the authorized person.
Our boutique will make and keep a copy of all documents in order to ensure the security of the customer and to prevent any fraudulent use of the customer’s identity and/or means of payment.
Before your order is delivered to you, you or the authorized person must sign the order delivery form. The signed delivery slip will be the proof of delivery and acceptance of the ordered products. If the package is deemed to have been delivered and our records provide proof of delivery, no dispute can be raised in relation to the delivery itself.
In the event that you do not come to collect your order within fourteen (14) days from the sending of the collection email, the contract will be automatically terminated and the order will be returned to our warehouse, no longer available for collection from our boutique, after which you will be refunded the amount paid for it.

If, for any reason, you do not agree with the procedure described in this section, we regret to inform you that you will not be able to take advantage of the store pick-up service.

RETURNS POLICY

a) General Provisions
If you wish to return any of the products previously purchased on the Website (except customized items and fragrances), within fourteen (14) calendar days from the date of receipt of the order, you must inform us of your intention to make the exchange or refund through one of these two options:
-by contacting our Customer Service via telephone +34 XXXXXXXXXX, the live chat on the Website or via email address contact@giannostransport.com , indicating your name, address and order number, after which we will send you an email confirming receipt of your withdrawal request.

  • by returning the products directly to one of our GIANNOS TRANSPORT SL boutiques located within the Spanish territory (excluding Duty Free stores at airports, Outlets and Authorized Distributors).

All returns must include the original purchase receipt and be returned in their original packaging. Please note that all returns and exchanges are subject to a quality control process prior to acceptance. Products that show signs of wear, deterioration, alterations (including size adaptations) or whose security label, if any, has been removed cannot be accepted. The amount corresponding to the value of the returned and accepted products will then be reimbursed, and GIANNOS TRANSPORT SL will bear the cost of returning the products by providing a return label. In case of depreciation of the value of the product as a result of improper handling for the preservation of the nature, characteristics and, if applicable, the proper functioning of the products, the responsibility will fall on you.

You may also use the return form If you choose to return the products at your own expense, we recommend that you keep the proof of registered mailing or the record of the date of shipment corresponding to the method used to carry out the return. The package must be insured against loss and theft for the value of the contents. GIANNOS TRANSPORT SL will not be responsible for loss or theft of products returned by its own means. The details of the different return procedures are listed below:

(b) Returns to our Customer Service Department.

When we receive your completed Return Form or notification of your intention to revoke your purchase, we will email you a return label with postage prepaid by us. You can also return the products by sending them directly to our store GIANNOS TRANSPORT SL at C/ JORGE LUIS BORGES, 4 BUZON 65URB.TERRA BRAVA together with the Return Form or a statement explaining your decision to cancel the contract, as specified in paragraph a). The products you wish to return must be shipped or delivered by hand without undue delay and within a maximum period of fourteen (14) calendar days from the day you inform us of your intention to terminate the purchase contract.

The refund will be credited to the same card with which the purchase was originally made on the Website. If the products are shipped before the end of the fourteen (14) calendar day period, they will be deemed to have been shipped within the time limit. If you wish to exchange the purchased product for a product of a higher value, you will be charged the difference. Unfortunately, it is not possible to exchange products for products of a lower value. The recipients of a gift have the right to exchange the products received for others of equal or higher value. Ordinary shipping costs of the order, if any, will be reimbursed. If you return the products purchased on the Website for an exchange, you will not be charged for the shipping costs incurred for the second delivery.

c) Returns to our boutique

ESPANA also offers the possibility of returning the products purchased on the Website directly to one of our GIANNOS TRANSPORT SL. stores located within the Spanish territory (excluding Duty Free stores at airports, Outlets and Authorized Distributors), for exchange or exchange for a boutique voucher, and to the store at C/ JORGE LUIS BORGES, 4 BUZON 65URB.TERRA BRAVA for exchange, refund or exchange for a boutique voucher.

If you wish to return any of the products purchased on the Website (except those that have been customized) that still have the security label, if applicable, within fourteen (14) calendar days from the date of receipt at the shipping address, or within fourteen (14) calendar days from the date of sending the Return Form or a statement explaining your decision to terminate the contract, as specified in paragraph a). If you wish to exchange the purchased product for a product of a higher value, you will be charged the difference. Otherwise, if you wish to exchange the purchased product for one of a lower value, you will be issued a boutique voucher for the difference. Recipients of a gift are entitled to exchange the products received for products of equal or higher value, or for a boutique voucher, provided that the original gift receipt is enclosed. Boutique vouchers can only be redeemed at one of our boutiques, excluding purchases through the Website.

WARRANTY

In addition to the legal warranties (Consumer Warranties) that may apply to the products purchased, which cannot be excluded or modified, the following warranty is provided in relation to the watches: the warranty for GIANNOS TRANSPORT SL watches is valid for three years from the date of purchase, is valid internationally and covers all manufacturing defects. This warranty does not cover normal deterioration of the case, the leather or metal strap, the crown or the crystal. The warranty is void in the event of loss, theft, misuse, neglect or attempted repair by unauthorized persons.

Under this warranty, you may send us your claim by email to contact@giannostransport.com , identifying the defective products and the nature and extent of the defect.
If you file a claim within the two years of validity of this warranty, GIANNOS TRANSPORT SL will carry out one of the following options:
(a) repair the products to which the defect relates; or
(b) replace the products to which the defect refers; and
(c) pay the costs associated with the delivery of the products that are under warranty.

DISCLAIMERS AND LIMITATIONS OF LIABILITY

With the exception of the Consumer Warranties and any express rights and warranties in these Terms and Conditions or otherwise provided with the products (including the Warranty), GIANNOS TRANSPORT SL excludes:
(a) any terms, conditions or warranties which may be implied in these Terms and Conditions;
(b) any liability to you for consequential or indirect loss.

GUARANTEE OF AUTHENTICITY

BULGARI guarantees the authenticity of all products marketed through the Website.
APPLICABLE LAW – ALLOCATION OF COMPETENCY – RESOLUTION OF DISPUTES ONLINE

Any cause of action that may arise under these Terms and Conditions shall be brought in the appropriate court in Madrid, and you agree to submit to the personal and exclusive jurisdiction of the appropriate courts of Madrid. The foregoing shall be without prejudice to our rights, which may not be excluded by the laws of your country of residence. Exclusive jurisdiction rests with the Spanish courts, and you agree to submit to the personal and exclusive jurisdiction of the corresponding Spanish courts. The foregoing shall not prejudice your rights, which may not be excluded by the laws of your country of residence.

FORCE MAJEURE

GIANNOS TRANSPORT SL shall not be liable for any delays in, or failure to comply with, the obligations specified in these Terms and Conditions arising from causes beyond our reasonable control, including cases of force majeure, as well as for incidents which cannot be foreseen or which, despite their foreseeability, are unavoidable.
Please note that nothing in these Terms and Conditions affects your statutory rights in any way.

DISCLAIMER OF LIABILITY

Our failure to insist immediately that you take any action required by these Terms and Conditions, or our delay in taking action against you for breach of this Agreement, does not mean that you do not have to take such action or prevent us from taking action against you at a later date. For example, if you miss a payment deadline and we not only do not send you a reminder for it, but we deliver the goods to you, we may still require you to make payment at a later date.

TERMINATION

If any provision of these Terms and Conditions is invalid by law, that provision shall be eliminated and the remainder of these Terms and Conditions shall continue to be valid and enforceable.

CHANGES TO THE TERMS AND CONDITIONS

We reserve the right to change these Terms and Conditions if necessary. You should therefore consult the Terms and Conditions before placing an order online.
